Upon booking with Pub Glamour Party Models you agree to be bound by the following
Terms and Conditions.
Definitions
'Pub Glamour' means Pub Glamour Party Models ABN 56 465 869 843.
'Client' or 'Clients' means a business or individual who books services offered by Pub Glamour Party Models.
'Model', Waitress', 'Card Dealer' or 'Showgirl' means a Contractor whom Pub Glamour engages to undertake these services.
'Us' means Pub Glamour as the case may be and 'we' and 'our' have corresponding meanings.
'You' means you the Client who has engaged us to provide services and 'your' has a corresponding meaning.
'Terms and Conditions' means the Terms and Conditions outlined on this web page.
1. General Terms
1a. Upon making your booking, you are engaging Pub Glamour the agency. The only booking type for which we guarantee specific individuals is Photographic Modelling assignments.
1b. We are not an escort agency. The Models we engage for Waitressing, Card Dealing and Shows are not available for sexual services of any kind, they are professional entertainers and promotional personnel only and requests for sexual services are considered offensive. Please do not request sexual services either during the Booking process or during your event.
1c. As an adult entertainment agency, we make no representation that our Models are professionally-trained hospitality personnel. The intrinsic value of our service lies in the presentation and personality of our personnel. If you are wanting to hire skilled wait or bar staff or Professional standard Card Dealers for your event, or require a 'Silver Service' standard of attendance, please inquire elsewhere.
1d. It is assumed that upon making your booking with Pub Glamour, you have read our FAQs.
1e. Uncontrollable factors such as bad weather, traffic incidents and delays at previous jobs can impact on travel time, so for Waitress / Card Dealer bookings, you should allow for 15 minutes' grace after your requested start time. For Showgirls, you should allow for a window of up to 1 hour, as they are usually travelling between many jobs on any given day. Please do not call us to inquire about your Model's whereabouts until these timeframes have been exceeded. Your flexibility is much appreciated.
1f. Your selected personnel are PREFERENCES ONLY and are not guaranteed. Models may be substituted at our discretion without notice or compensation if changes to our roster are required for any reason, although every effort will be made to match your general physical preferences with the appropriate Model/s. In the event of substitution you may not reject the substitute Model/s, or attempt to negotiate a discount, or refuse to pay upfront, or in any other way breach the Terms and Conditions. If there are any Models on our website or whose images have been emailed to you whom you specifically do NOT want at your event, you must notify us when booking.
1g. Our Models may change details of their appearance at any time (eg hair colour, hairstyle, piercings, tattoos etc), at their discretion and without notice.
1h. Private party groups are presumed to be all-male and legal adults UNLESS YOU TELL US OTHERWISE. You must let us know if your group includes women or minors, as a) some Models accept work with certain gender and/or age groups only, and/or b) Models will select their outfits according to the gender and/or age makeup of the group. If you fail to advise us, and the Model/s decide not to proceed with the job due to group members that they deem inappropriate and/or outfit selection that they deem inappropriate for the group, you will be required to pay the Model/s in full and you will not be entitled to a refund of your deposit.
1i. Private party groups are required to consist of at least 5 people. We do not supply Models for groups any fewer in number. If your group consists of fewer than 5 people and you either lie about this or fail to advise us in advance, and the Model/s decide not to proceed with the job on this basis, you will be required to pay the Model/s in full and you will not be entitled to a refund of your deposit.
1j. It is your responsibility to carefully read and verify the information provided in your Booking Confirmation, and advise us immediately of any errors. This information is forwarded verbatim to the Models, and full payment as per your Booking Confirmation is required in the event of you providing incorrect information that results in delays, lost time or failure of our Models to carry out their duties. Any resultant loss will be borne by you. In the same vein, it is your responsibility to be contactable on your supplied mobile phone number from at least an hour before the booking start time, so that your Model/s may contact you regarding access, directions etc.
1k. The client upon booking with Pub Glamour Party Models accepts and agrees to the following terms of liability:
That Pub Glamour Party Models acts as a booking agent that engages the services of Independent Contractors. Contractors are not staff. The Contractor is totally responsible for providing her own liability insurance and professional indemnity to adequately cover any liability that the Contractor may incur. Pub Glamour Party Models accepts no responsibility or liability for any action of a Contractor in the performance of the Contract with Pub Glamour Party Models. Simply put, any injury to persons or damage to property caused by a Contractor is a legal matter between the Client and the Contractor.
1l. As the booking organiser, it is your responsibility to ensure all guests are aware of, and abide by, the Terms and Conditions.
2. Pricing
2a. All prices quoted exclude GST. Please add 10% GST if you require a Tax Invoice.
2b. We require a deposit to secure your Pub Glamour party booking, to be paid via Bank Deposit.
2bi. The deposit amount will vary from booking to booking depending on total hours booked and type of service booked (eg Waitressing / Card Dealing or Show) and will be stipulated in your Booking Confirmation email.
2bii. Please pay your deposit and provide a Payment Receipt by the date stipulated in your Booking Confirmation, or your requested Model/s will be taken off hold and made available for other bookings.
2biii. If the deposit has not landed in our account by the date of the booking, payment for the booking IN FULL must be made to the Model/s on the day. If/when the deposit shows in our account at a later date it will be refunded.
2biv. The deposit is not refundable if less than 28 days' cancellation notice is given by you. It is our fee to organise the Models. When Models commit to a job they have to turn down other opportunities. A cancellation is serious: it affects the Models and our business. A booking is also considered cancelled for the purposes of non-refundable deposits if, after we have locked in your original requirements, you request significant changes to the spirit or specifics of your booking that we are unable to accommodate due to reasons of Model availability or to the nature of the change, eg a different booking time, a different Model outfit, a different type of venue etc.
2c. At our discretion, for bookings taken for which there is insufficient time for a deposit to be made, your credit card details will be recorded and a $150 Booking Fee will be deducted in the event of cancellation.
2d. All bookings that require significant travel will be charged a per-girl Travel Fee. Travel Fees are charged based on a CBD starting point. The amount of your Travel Fee will vary depending on the location of your booking, and will be advised in your Quote or, if the need for Travel Fee/s arises or comes to light after you confirm a booking, in later correspondence. You must advise Pub Glamour in advance if this circumstance applies to your booking.
2e. All bookings that require the Model/s to use a paid parking facility (car park or street parking) will incur a reimbursement or subsidy charge for a nominal amount. This amount will vary from booking to booking and will be advised in your Quote or, if the need for paid parking arises or comes to light after you confirm a booking, in later correspondence. You must advise Pub Glamour in advance if this circumstance applies to your booking.
2f. All bookings which start at one location and finish at another (eg party bus / limo tours or cruises) will incur a reimbursement or subsidy charge to cover the models' taxi costs to return to the original location, as calculated at www.taxifare.com.au. This fee will vary from booking to booking and will be advised in your Quote or, if the need for this charge arises or comes to light after you confirm a booking, in later correspondence. You must advise Pub Glamour in advance if this circumstance applies to your booking.
2g. All bookings which take place at multiple venues will be charged as a continuous block, with no deductions for the time the Model/s spend travelling between venues. For example, if your Model/s start their booking at one location at 7.00pm and then after an hour move to a different venue, such as a pub function room, until 10.00pm, this constitutes a 3-hour booking and will be charged as such. This clause also applies to bookings where an outfit change is required, and it is reasonable to expect that this may take 5 to 10 minutes.
2h. All bookings which are delayed at your end for any reason (eg if you arrive late to the venue) will conclude at the booked time with no change to the original agreed payment to your Model. For example, if your Model is booked for a 7.00-9.00pm job and her start time is delayed for 20 minutes, she will collect her full 2 hours' of pay and conclude the job at 9.00pm.
2i. Waitress / Card Dealer bookings that are extended on the day will be charged Per Model at the hourly rate stipulated in your Booking Confirmation email, per half-hour or part thereof of extra time worked.
2j. Waitress / Card Dealer bookings that run overtime by more than 10 minutes for any reason (eg bus / boat delays) will be charged Per Model at Double Time the hourly rate stipulated in your Booking Confirmation email, per half-hour or part thereof of extra time detained. Showgirl bookings will incur a $200 charge per half-hour of delay extending beyond the agreed timeframe of your booking. In the event of delay, Models will be fully dressed in their street clothes and will not be working or interacting with guests unless they choose to do so. Payment is required to be made in cash directly to the Model/s on the day without argument or resistance. You accept and agree that the Models must be reimbursed for their time, inconvenience, stress, inability to attend other bookings, and general impact on their rosters as outlined herein, and that these terms and charges are not negotiable.
3. Refunds
3a. FOR NO-SHOWS - You are entitled to a full refund of your deposit for any no-show. For Waitresses and Card Dealers, a no-show is recognised when the Model has not arrived, and has given no advance notice, more than 45 minutes after the stipulated booking time. For Showgirls, a no-show is recognised when the Model has not arrived, and has given no advance notice, more than 1.5 hours after the stipulated booking time. Please request your refund via email to info@pubglamour.com.au. In making your booking you agree that Pub Glamour bears no liability for Contractor no-shows.
3b. FOR LATE ARRIVALS - You are entitled to shorten a Waitress or Card Dealer booking if your Model arrives more than 30 minutes late, by no more than the amount of time she is late. Payment will be due pro-rata as per your Booking Confirmation - you may not negotiate the payment amount with the Model. As above in 'For No-Shows', you are entitled to cancel your Waitress or Card Dealer if she arrives more than 45 minutes late or your Showgirl if she arrives more than 1.5 hours late, having given no advance notice, in which case you will be entitled to a full refund of your deposit. Please request your refund via email to info@pubglamour.com.au. In making your booking you agree that Pub Glamour bears no liability for Contractor late arrivals.
3c. Refund amounts are calculated on an individual basis, ie the amount of the deposit that was applicable to the no-show model.
3d. FOR REPLACEMENT MODELS - As outlined above in '1. General Terms', the personnel you select upon booking are preferences ONLY and are not guaranteed, therefore no refund is applicable. Refer 1f.
3e. FOR CANCELLATIONS - If your Model cancels at late notice, we may be unable to find you a replacement model despite all best efforts. Please forward your bank details for deposit refund to info@pubglamour.com.au. In making your booking you agree that Pub Glamour bears no liability for unavoidable cancellations.
3ei. You accept that for bookings of two or more Waitresses / Card Dealers, where one of the booked Models cancels or is otherwise unavailable, you are obligated to proceed with the other Model/s' booking - you may not reject the other Model/s, or attempt to negotiate a discount, or refuse to pay upfront, or in any other way breach the Terms and Conditions.
3eii. You accept that for bookings of two Waitresses / Card Dealers, where one of the booked Models cancels or is otherwise unavailable, and the other Model is not willing to work alone, a complete cancellation of your booking may occur. This is a very rare and regrettable situation but it is sometimes unavoidable.
4. Waitresses & Card Dealers
4a. You cannot touch the Waitresses / Card Dealers at all.
4b. You are required to pay the Waitresses / Card Dealers in cash when they arrive, before they get changed and commence working.
4c. You must ask the Waitress's / Card Dealer's permission if you wish to record or broadcast her in any way - this includes cameras, videos, mobile phones, Skype, webcams, and any other types of visual or audio media. If she declines, you must respect this decision.
4d. Waitresses / Card Dealers will provide your party with drinks service / card dealing (as booked), conversation, and gorgeous eye candy - they are NOT performers. If your Waitress / Card Dealer is not booked for a show, PLEASE DO NOT ASK.
4e. Waitresses booked to serve alcohol is a licensed venue, whether in a public or private area, are required by law to be RSA-certified.
4ei. You must advise if this requirement applies to your booking so we can ensure your personnel are correctly certified. If you expressly advise us that you have made your own inquiries and RSA is not required, and in fact it is, you agree to bear full and exclusive responsibility for any fines incurred on behalf of the Contractor/s and Pub Glamour.
4eii. You must also confirm with venue management IN ADVANCE (that is, before making your inquiry with Pub Glamour) that Waitresses / Card Dealers are permitted to work on the premises in your required capacity, as it is a waste of everybody's time to organise models and then learn they are not permitted at the venue.
4f. If the rules are broken, the Model/s reserve the right to leave immediately without notice or restraint, and no refund will be given. As the booking organiser, it is your responsibility to ensure all guests are aware of, and abide by, the Terms and Conditions.
5. Showgirls
5a. Most, if not all, Showgirls travel with personal security. If this is a problem for you, do not book with Pub Glamour. You will NOT be entitled to a refund if you decide you wish your Showgirl's security to be absent during the Show. This is not an option.
5b. You cannot touch the Showgirl, unless she chooses to involve you in her show. In this case, she MAY allow guided touching, eg thighs or breasts. This choice is up to the individual Showgirl and you may ONLY touch the areas the Showgirl directs you to touch during the entertainment.
5c. Strictly no cameras or broadcast / recording devices are permitted to be used during the Show. You must ask the Showgirl's permission if you wish to record or broadcast her or her performance in any way. If she declines, you must respect this decision.
5d. You cannot be obscene or insult the Showgirls in any way.
5e. We will not book X- or XXX-Rated Shows for functions where women will be present. We will ONLY provide G-String or Straight Nude strips to mixed crowds. X- and XXX-Rated Shows are STRICTLY for male crowds only.
5f. You may be required to provide a room for the Showgirl to change into her costume. If you are planning your entertainer to be a surprise, please let us know when booking and we will organise for the performer to be in costume upon arrival.
5g. The Showgirls do not perform outdoor Shows on grass or dirty surfaces. You must provide a clean, stable, covered area, eg a patio or garage.
5h. If your Showgirl is required to attend a licensed venue (for performance strictly in a privately-hired area), you must confirm in advance with venue management that Showgirls are permitted to perform on the premises, as it is a waste of everybody's time to organise the booking and then discover she is not permitted at the venue.
5i. If the rules are broken, the Show will be stopped immediately and no refund will be given. As the booking organiser, it is your responsibility to ensure all guests are aware of, and abide by, the Terms and Conditions.
